General Terms and Conditions

Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Cooling-off period: The period within which the consumer may exercise the right of withdrawal.
Consumer: The natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.
Day: Calendar day.
Long-term transaction: A distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
Durable data carrier: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: A contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.
Means of distance communication: Any means that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same place.
General Terms and Conditions: These current terms and conditions of the entrepreneur.


Article 2 – Right of withdrawal
The consumer has the right to withdraw from the agreement within a cooling-off period of 30 days without giving any reason. During this period, the consumer shall handle the product and packaging with care.
If the consumer exercises the right of withdrawal, they must return the product with all delivered accessories and, if reasonably possible, in its original condition, in accordance with the reasonable instructions of the entrepreneur.


Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, it shall be indicated before the contract is concluded that the terms and conditions are available for inspection at the entrepreneur’s premises and will be sent free of charge upon request.
If the contract is concluded electronically, the terms and conditions may be provided electronically in such a way that the consumer can easily store them on a durable data carrier.
If additional product or service conditions apply, the consumer may always rely on the most favorable provision in case of conflicting conditions.
If any provision is void or annulled, the remaining provisions remain in force.
Situations not covered by these terms shall be assessed in the spirit of these terms.


Article 4 – The offer
If an offer has a limited validity or is subject to conditions, this will be explicitly stated. The offer is non-binding.
The entrepreneur may change or adjust the offer.
The offer contains a complete and accurate description of the products and/or services.
Images are a truthful representation of the products. Obvious mistakes or errors do not bind the entrepreneur.
All images and specifications are indicative and cannot give rise to compensation or termination of the agreement.
Colors may slightly differ from reality.
Each offer contains sufficient information regarding:

  • shipping costs
  • how the agreement is formed
  • whether the right of withdrawal applies
  • payment, delivery, and execution methods
  • acceptance period or price guarantee period
  • communication costs (if applicable)
  • archiving of the contract
  • how the consumer can check and correct provided data
  • available languages
  • applicable codes of conduct
  • minimum duration of long-term contracts
  • optional sizes, colors, and materials

Article 5 – The agreement
The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
The entrepreneur confirms acceptance electronically.
The entrepreneur ensures a secure electronic environment.
The entrepreneur may assess whether the consumer can meet payment obligations and may refuse or attach conditions to the order.
The entrepreneur provides the consumer with necessary information regarding complaints, withdrawal rights, guarantees, and contract data.


Article 6 – Right of withdrawal
Consumers may cancel the agreement within 30 days without giving reasons.
The cooling-off period starts the day after the consumer receives the product.
The consumer must handle the product carefully and may only unpack/use it as necessary to assess it.
If the right of withdrawal is exercised, the product must be returned with all accessories and in original condition where possible.
The consumer must notify the entrepreneur within 30 days via written notice or email.
The product must then be returned within 30 days. Proof of return is required.
If deadlines are exceeded, the purchase is final.


Article 7 – Costs in case of withdrawal
Return shipping costs are borne by the consumer.
Refunds will be made within 30 days after withdrawal, provided the product has been received or proof of return has been provided.


Article 8 – Exclusion of the right of withdrawal
The entrepreneur may exclude the right of withdrawal for specific products, provided this is clearly stated in the offer.
Exclusion applies to products:

  • made to consumer specifications
  • personal in nature
  • not suitable for return
  • perishable or aging quickly
  • subject to financial market fluctuations
  • newspapers and magazines
  • sealed media/software/hygiene products once unsealed

Article 9 – Price
Prices remain valid during the offer period except VAT changes.
Variable pricing may apply for products affected by market fluctuations.
Price increases within 3 months are only allowed due to legal regulations.
After 3 months, price increases are allowed if the consumer may terminate the agreement.
No liability is accepted for typographical errors.


Article 10 – Conformity and warranty
Products must conform to the agreement and legal requirements.
Warranty does not affect statutory rights.
Defects must be reported within 30 days.
Warranty equals manufacturer warranty unless otherwise stated.
Warranty does not apply if products are misused, altered, or exposed to abnormal conditions.


Article 11 – Delivery and execution
Orders are processed with care and delivered within 30 days unless otherwise agreed.
Delays will be communicated. Consumers may cancel and receive refunds if delivery fails.
Risk transfers upon delivery. Replacement products may be offered.


Article 12 – Long-term transactions: duration, termination, and renewal
Consumers may cancel long-term contracts with up to one month notice.
Such contracts cannot be silently renewed except under specific conditions.
Subscriptions for newspapers/magazines may be extended temporarily but remain cancellable.


Article 13 – Payment
Payments must be made within 7 days after the cooling-off period unless otherwise agreed.
Consumers must report incorrect payment details.
Late payment may result in reasonable additional costs.


Article 14 – Complaints procedure
Complaints must be submitted within 7 days.
Responses are provided within 14 days.
If longer processing is needed, acknowledgment will be sent with an expected timeline.
Unresolved complaints become disputes.
Complaints do not suspend obligations unless stated.
Valid complaints may result in replacement or repair.


Article 15 – Disputes
All agreements are governed exclusively by dutch law, even if the consumer resides abroad.
